Charmaine has considerable experience in all aspects of the insolvency space, being both corporate insolvency and bankruptcy. She regularly acts for external administrators, directors and officers, creditors and other interested parties in a wide range of disputes and claims of both large scale/high value, and of smaller value.

Expertise

Charmaine regularly represents clients in respect of matters such as voidable transaction claims, insolvent trading, shareholder oppression, misleading and deceptive conduct claims, and public examinations. She also assists clients through every step of the voluntary administration, liquidation, and bankruptcy processes, including winding up/bankruptcy applications, development and implementation of deeds of company arrangement and small business restructures, and recovery actions commenced by external administrators. In addition, Charmaine provides advice to directors of insolvent companies in respect of matters such as safe harbour, personal liability and directors’ and officers’ insurance claims.

Charmaine also acts for and advises insolvency practitioners on all aspects of their appointments and regularly appears in the Supreme and Federal Courts for a wide range of applications required as part of the external administration process.

In addition to her insolvency practice, Charmaine has experience in commercial matters including business and share sale transactions, lease and franchise agreements, freezing orders, personal guarantees, and general commercial disputes. She also provides advice on various matters regarding security interests and the Personal Property Securities Act 2009 (Cth).

Charmaine approaches all matters in a pragmatic and commercial manner and strives to obtain the best outcome for her clients, taking into account the potential costs and risks of each matter.
